3.6. By entering the Promotion, the participant agrees to be unconditionallybound by these terms and conditions.
3.7. The Promoter takes no responsibility for prize winner's claims that arelost, damaged or delayed in the post. Proof of posting is not proof of receiptor of prize entitlement. Receipts will not be returned.
3.8. No responsibility is accepted for any incomplete, ineligible entries(which may be disqualified at The Promoter's discretion) or entries which failto arrive if requested.
3.9. Bulk entries made from trade; consumer groups or third parties will not beaccepted. If it becomes apparent that a participant is using a computer(s) tocircumvent this condition by, for example, the use of ‘script’, ‘brute force’or any other automated means, that person’s entries will be disqualified andany prize award will be void.
3.10. There are no cash or other alternatives in whole or in part to the statedprizes and unless otherwise agreed in writing by The Promoter, the prizes willonly be awarded directly to the winners.
3.11. The Promoter reserves the right to substitute the prize of equal orgreater value in the event of unavailability due to circumstances beyond ThePromoter’s control.
3.12. The Promoter reserves the right to verify all entries including but notlimited to asking for proof of purchase, address and identity details (whichthey must provide within 14 days) and refuse to award a prize or withdraw prizeentitlement and disqualify the participant where there are reasonable groundsto believe there has been a breach of these terms and conditions or anyinstructions forming part of this Promotion’s entry requirements or otherwisewhere a participant has gained unfair advantage in participating in the Promotionor won using fraudulent means. The Promoter will be the final arbiter in anydecisions, and these will be binding and no correspondence will be enteredinto.
3.13. Please allow up to 35 days for delivery of prizes from the date of winnerconfirmation.
3.14. Reasonable efforts will be made to contact the winners. If the winnercannot be contacted within 14 days of notification or is unable to comply withthese terms and conditions, The Promoter reserves the right to offer the prizeto the next eligible entrant drawn at random. The Promoter will have finaldiscretion on all elements and aspects of how the prize is organised. Once theprize details including the details of any guests, dates, locations andactivities are confirmed, this cannot be amended or altered by the winner.
3.15. In the event of circumstances outside the reasonable control of ThePromoter, or otherwise where fraud, abuse, and/or an error (human or computer)affects the proper operation of this Promotion, and only where circumstancesmake this unavoidable, The Promoter reserves the right to cancel or amend the Promotionor these terms and conditions, at any stage, but will always endeavour tominimise the effect to participants in order to avoid disappointment.
3.16. Insofar as permitted by law and without prejudice to entrants’ statutoryrights, The Promoter and On the Beach cannot accept any responsibility andexclude all liability for any damage, loss or injury suffered by any entrantentering the Promotion or as a result of accepting or participating in anyprize. Nothing in these Entry Terms and Conditions shall exclude or limit ThePromoter’s or On the Beach’s liability for death or personal injury as a resultof their negligence or any other liability that cannot lawfully be excluded orlimited.
3.17. The rules of the Promotion are subject to the legal and regulatoryrestrictions imposed under the laws of England and Wales and the parties to anydispute or action shall submit to the exclusive jurisdiction of the English courts.
3.18. Your name and address will be retained by The Promoter and used inaccordance with the Data Protection Act 2018. Your personal details will not bepassed onto third parties except as set out in clause 5 above. You may becontacted by The Promoter unless you opt out of further communications. Bysubmitting an entry, you consent to The Promoter processing and using your datafor the purposes of administrating the Competition.
3.19. The name and counties of the winners will be available by sending anemail to info@thepizzacompanyuk.com whichwill be available after 28 September 2026 for 6 weeks. 3.21. The Promoter cannot be held responsible for any third-party products orservices. To report any technical faults, issues with prizes please contact ThePizza Company on info@thepizzacompanyuk.com.3.22.By accepting a prize, the winner agrees to release and hold harmless ThePromoter and On the Beach and their subsidiaries, affiliates, suppliers,distributors, agencies and each of their respective parent companies and eachsuch company's officers, directors, employees and agents (collectively, the"Released Parties") from and against any claim or cause of action,including, but not limited to, damage to or loss of property, arising out ofparticipation in the Promotion or receipt of, use or misuse of any prize. 
3.23. The Released Parties are not responsible for:
3.24. Any incorrect or inaccurate information, whether caused by entrants,printing errors or by any of the equipment or programming associated with orutilized in the Promotion;
3.25. Technical failures of any kind, including, but not limited tomalfunctions, interruptions, or disconnections in phone lines or networkhardware or software failures of any kind including any injury or damage to anyperson's computer account resulting from participating in this Promotion, ormis-transcribed data;
3.26. Unauthorized human intervention or human error which may occur in anypart of the entry process or the process for allocating the prize(s);
3.27. Technical or human error which may occur in the administration of the Promotionor the processing of entries;
3.28. Late, lost, undeliverable, damaged or stolen post; or
3.29. Any injury or damage to persons or property which may be caused, directlyor indirectly, in whole or in part, from the participant's participation in thePromotion or receipt or use or misuse of any prize. If for any reason, anentrant's entry is confirmed to have been erroneously deleted, lost, orotherwise destroyed or corrupted, entrant's sole remedy is another entry in thePromotion, if it is possible. Nothing in this section shall exclude or limitthe Released Parties' liability for death or personal injury caused by itsnegligence, for fraud or fraudulent misrepresentation, or for any otherliability the exclusion or limitation of which is prohibited by law.
3.30. Use of a false name or address will result in disqualification.
3.31. Entries that are incomplete, illegible, altered, reconstructed, forged ortampered with, inaudible or indecipherable will not be valid and deemed void.
3.32. All entries must be made directly by the person entering the Promotion.
3.33. Entries from agents, third parties, organised groups or entriesautomatically generated by computer or completed in bulk, will not be accepted.No incomplete or corrupted entries will be accepted. Entries will only beaccepted if they comply with these terms and conditions.
3.34. No responsibility can be accepted for entries or claims that are notsubmitted on time or in full, lost, mislaid, damaged, or delayed viae-mail/phone, regardless of cause, including, but not limited to, equipmentfailure, technical malfunction, systems, satellite, network, server, computerhardware or software failure of any kind, or corrupted webpages.3.35.The winners and their companions are responsible for any expenses which may beincurred by the winners in claiming any prize.
3.36. The Promoter's decision is final in relation to Promotional matters, andno correspondence or discussion will be entered into.
3.37. In the event of a discrepancy between these terms and conditions and thedetails in the Promotional material, these terms shall prevail.

The Promoter reserves the right to verify all entries, including but notlimited to asking for address and identity details and to refuse to award aprize or withdraw prize entitlement and/or refuse further participation in the Promotionand disqualify the participant where there are reasonable grounds to believe:
3.39. there has been a breach of the set terms and conditions;
3.40. there has been a breach of any law; or
3.41. there has been a breach of any instructions forming part of this Promotion'sentry requirements or otherwise;

3.43. an entry infringes any right; or

3.46. If any provision of these terms and conditions (or any part thereof) isheld to be invalid or unenforceable, all remaining provisions (or part thereof)will remain in full force and effect.

Data Protection: Where you participate in a Promotion, your personal datashall be processed in accordance with our Privacy Policy available here. Bysubmitting an entry, the participant acknowledges that the processing ofhis/her personal data is necessary for The Promoter to fulfil its obligationsto the participant in respect of the Competition and to enable the participantto enter the Promotion, visit and use the Promotor’s Website and/or to claimany prize they may win. The participant confirms and warrants that all dataprovided by them for these purposes are accurate. If the participant exercisestheir right to object to the processing of such personal data with theconsequence that it is not possible to administer the Promotion in respect ofthat participant, their participation may be cancelled.

3.50. The winner is responsible for the behaviour of themselves and theirguests whilst taking any prizes. The Promoter reserves the right in itsabsolute discretion to exclude the winner and/or their guests fromparticipation in any aspect of the prize if any party fails to comply with thedirections of The Promoter or any companies associated with the prize or if thewinner and/or their guests act in a manner that is dangerous to themselves orto the public or is, in the opinion of The Promoter, anti-social in any manneror which causes a disturbance or nuisance to others.
